We strictly operate within the framework of the Constitution of India, Bharatiya Nyaya Sanhita (BNS) 2023, Information Technology Act 2000 & Indian Telegraph Act.WHAT WE DO (DO’s)
1. Lawful Information Gathering: We collect information only through public records, field inquiry, and open-source intelligence (OSINT) with client consent.
2. Court-Admissible Evidence: We maintain proper chain of custody, hash value and metadata for all digital evidence as per Bharatiya Sakshya Adhiniyam (BSA) 2023.
3. Client Confidentiality: We maintain discretion and confidentiality as per Section 356 of BNS (Defamation protection).
4. Cooperation with Law Enforcement: If we discover any serious cognizable offence during investigation, we immediately inform the concerned police authority.WHAT WE DO NOT DO (DON’Ts) – Strictly ProhibitedAs per the proposed Private Detective Agencies (Regulation) Bill & BNS 2023, we DO NOT undertake the following illegal activities:1. No Illegal Trespass: We do not enter any private property, house, or office without permission. Such act is punishable under BNS Section 329 (Criminal Trespass) & Section 330 (House-Trespass) – up to 1 year imprisonment.2. No Call Detail Records (CDR) / Call Interception: We do not provide Call Detail Records, call recording, or WhatsApp chats. Unauthorized interception is illegal under Section 72 of IT Act 2000 & Section 5(2) of Indian Telegraph Act 1885 and violates Right to Privacy under Article 21.3. No Stalking or Harassment: We do not stalk any person physically or digitally. Stalking is a criminal offence under BNS Section 78.4. No Hacking, Impersonation or Data Theft: We do not hack emails, phones, or impersonate as police/CBI. Such acts are punishable under BNS Section 318 (Cheating) & IT Act Section 66.
5. No Interference in Government Affairs: We do not investigate affairs related to IB, RAW, CBI, Army or any state agency.Our Commitment: We at Active Eye India completely obey the laws made by the Government of India.
